1. INTRODUCTION
1.1 The comfort and convenience of all Members will be served by observance of all Club Rules and regulations. It is the responsibility of each Member to familiarise himself, his family and guests with all aspects of the Club Rules which will be strictly and consistently enforced.
1.2 The Committee has reviewed and approved the Club Rules and regulations as defined in this handbook. The Committee may, in its discretion, amend, adopt or delete any Rule from time to time. Notice of any such changes will be published on the Club notice board.
1.3 The only persons who may, in special circumstances, permit a temporary waiver of compliance with a Club rule are the Chairman, the Captain or the General Manager. Members of the Committee, (other than the Chairman and Captain), and Club staff have no authority to permit any such waiver and Members must not embarrass them by asking for a temporary waiver.
1.4 These Rules must be read in conjunction with the Articles of Association of the Company and in the case of any conflict the provisions of the Articles of Association shall prevail.
2. DEFINITIONS
In these Rules the following definitions have the following meanings:
2.1 “the Club” means Hartsbourne Country Club, its agents and/or employees, and includes the entirety of the Club premises comprising the Club House, Terrace, Golf Courses and Practice Areas, Swimming Pool, Tennis Court, Car Parks and all storage and maintenance areas.
2.2 "Committee" means the General Committee.
2.3 "the Company" means Hartsbourne Country Club (Members) Limited.
2.4 “Member” means any person admitted to any category of membership in the Club.
2.5 "T & H Committee" means the Tournament and Handicap Committee.
2.6 Any reference to the singular includes a reference to the plural and vice versa and any reference to the masculine includes a reference to the feminine.
3.2 Any question concerning the application or interpretation of any Rule must first be put to the General Manager in writing for a decision. The General Manager may, if he considers it necessary, refer the matter to the Chairman, the Captain or the Committee.
4. ACCOUNTS and COLLECTION POLICY
4.1 Annual subscriptions are billed in December for the following year. Members may elect to pay the annual subscription by one payment on January 1 st, by two equal instalments on January 1 st and July 1 st or by ten monthly instalments by Bankers’ Standing Order beginning in January.
4.2 Members must notify the Club, in writing, no later than December 31 st in each year if an election is made to pay by instalments. In the absence of any notification the full subscription will be due and payable on January 1 st.
4.3 A Service Charge will be made in respect of all instalment payments.
4.4 Subject only as above, all Members’ accounts are due and payable upon receipt.
Overdue accounts
4.5 An account is overdue if it is not paid within thirty (30) days from due date.
Thirty (30) day Balances Overdue
4.6 Members with overdue accounts having thirty (30) day balances will be charged a service charge of 1.5% per month.
Sixty (60) day Balances Overdue
4.7 Members with overdue accounts having sixty (60) day balances may be sent a Notice advising that the Club has:
4.7.1 charged a service charge of 1.5% per month from the inception of the overdue balance
4.7.2 suspended membership privileges until the account balance is paid in full.
5. ACTIVITIES
5.1 The Committee may prohibit any activities which, in its judgment, it considers to be prejudicial to the interests of the Members or the Club.
5.2 Members may hire Club facilities for private functions provided such functions do not interfere with the normal operation of the Club or with services regularly available to its members and guests.
5.3 Members must co-ordinate all private functions through the Club Office to which enquiries must be addressed.
6. CHILDREN
6.1 Members are responsible for the conduct of their children/grandchildren at all times and must ensure that they do not disturb other Members and their guests.
6.2 Running is not permitted in the dining, lounge, terrace or TV areas. Members will be asked to remove unruly children from these areas.
6.3 Children under 12 years of age are allowed in the Dining Room and Spike Bar only when accompanied by an adult. Young persons under the age of 16 may not sit at the Bar.
6.4 Prams, pushchairs, carrycots and similar items may not be brought into the Dining Room nor on to the Terrace.
7. CLUB OFFICE
7.1 The Club Office is normally open between 9.00 am and 5.00 pm Monday to Friday, including Bank Holidays, and 9.00 am to 4.00 pm on Saturday and Sunday.
7.2 Account balances and other financial information is available, Monday to Friday only, from the Office.
8. CLUB MEMBERSHIP CARDS
8.1 Members should ensure that they have in their possession at all times while on Club premises a valid Membership Card.
9. CONDUCT AND DISCIPLINE
9.1 A Member, guest or other person entitled to use Club premises whose conduct at any time is improper or likely to harm the welfare, safety, decorum or good reputation of the Club, its Members or its employees, shall be subject to Club disciplinary action which may result in reprimand, suspension or expulsion in accordance with the Articles of Association of the Company.
Grounds for disciplinary action include, but are not limited to:
9.2.1 verbal, sexual or other harassment of a Club employee, Member or guest
9.2.2 abusive language or behaviour to a Club employee, Member or guest
9.2.3 action towards a Club employee which threatens his employment, undermines employee morale or is demeaning to the employee, or which misrepresents the Member’s authority.
9.2.4 failure to abide by Club Rules and regulations.
